Terms of Service

Pre-production:

Depending on the scale of the production, allow for 10-business days before the first production date and deposit/payment received, in order to fully prepare for your project. Open communication is necessary, please provide all final briefs, scripts, references, and production details at least 72-hours prior to the production date.

 Production:

We do our best to complete your project in the shortest amount of time, whilst aiming for the best quality results, please allow for a 10-business days turn-around per project depending on the size of the project and what has been agreed upon during pre-production. Deadlines requested prior to the agreed-upon date will be subject to an expedite fee of 5% of the total balance per day expedited.

Revisions:

Please ensure that you have provided detailed feedback within 14-business days of delivery. If no feedback has been received thereafter, a 5% late feedback fee shall be added to the final invoice per day outstanding. The project includes 3x free revisions for minor adjustments, additional revisions may be requested as per the terms of service.

Deadlines:

It is in our best interest to make sure that the agreed-upon deadline has been met, however, factors outside of our control may occur, in such cases, we require an extension period of 5-business days.

Quality:

It is the essence of this agreement that all completed media and services supplied by Unbox Galaxies shall be of applicable industry standards. Please download all exported versions for the best quality experience. Production value may be determined by the available resources, time, and budget available to invest into the overall project.

Delivery:

All production versions shall be exported to the client via a Google Drive link. Please make sure that you have downloaded all necessary versions as all data will be deleted after 14-days post the final delivery. A hard-drive copy may be requested by the client at the expense of the client. 

Unbox Galaxies reserves the right to use the produced project as part of our portfolio.

 Payment:

Full-production projects: 

Stage 1: A 50% deposit is required before any production commences. Stage 2: Stage 2: The remaining 50% balance is due before delivery of the final product. Once Full payment has been received, the client shall then own all rights to the final project.

Pre-production projects: 

Stage 1: 100% balance is required before any production commences.

Retainer projects: 

Stage 1: 100% balance is required on the 1st day of each month before any production commences.

Notice of potential fees: 

It is intended for all parties to receive a mutually beneficial working relationship to achieve the final product within a realistic manner.

The final balance specified on your invoice is due within 30-business days of receiving the final product, thereafter any outstanding balance will be subject to a 10% late fee.

Minor revisions: 5% of the invoice balance.

Major revisions: 25% of the invoice balance.

Late feedback fee: 5% of the invoice balance.

Notice: All fees are calculated based on the total invoice balance per project.

 Termination:

Each party may terminate this agreement at any given time. a) In the event that Unbox Galaxies terminates the contract before any work commences, a full refund shall be issued. b) Termination mid-way through production will result in a 50% refund being issued. In both instances, a substitute contact or reschedule plan shall be provided if applicable, and all raw material produced as a result of the production shoot will be sent to the client.

1. a) In the event that the client terminates the agreement after pre-production and before the initiation of the production commences, a 80% refund shall be issued. b) Termination after production; No refund shall be issued after the initiation production and/or delivery. 

Pre-production only projects: a) No refund shall be issued after the initiation of any work executed.

In the event of the client terminating the agreement, all raw materials and product versions to the date of termination shall be released to the client post receipt of the final balance. 

Notice: All refunds are calculated based on the total invoice balance.

 Indemnity:

The client agrees to indemnify Unbox Galaxies and its representatives against any claims, actions, liabilities, and expenses that occur due to a breach of agreed communications discussed between Unbox Galaxies and the client.

The client agrees to indemnify Unbox Galaxies and its representatives against any damage, loss, injury or factors that occur beyond our control that may occur during the course of the production.

 Confidentiality:

All parties agree to keep a reasonable level of confidentiality towards important information that has been discussed unless specified or within the public domain.

 Queries:

It is intended that all parties receive a great business relationship and experience, however, in the event of any concerns, suggestions, or disputes please email info@unboxgalaxies.com  within 24-hours of the query.

 Law: 

This terms of service agreement and various agreed upon communication channels between Ubox Directors and the Client shall be used as a legally binding agreement under South African law. Upon accepting our Invoice and/or our quotation and/or service you agree to accept all terms within this terms of service agreement.
